1. General Conditions & Eligibility

Age Requirement:
Purchasers must meet all applicable federal, state, and local legal requirements to purchase, possess, receive, or transfer firearms, ammunition, or regulated firearm components.

Federal Minimum Age Requirements:
Under federal law, including regulations governing Federal Firearms Licensees (FFLs):

• Individuals must be at least 18 years of age to purchase rifles or shotguns from a licensed dealer.
• Individuals must be at least 21 years of age to purchase handguns from a licensed dealer.
• Individuals must be at least 18 years of age to purchase ammunition intended for use in rifles or shotguns from a licensed dealer.
• Individuals must be at least 21 years of age to purchase ammunition intended for use in handguns from a licensed dealer.
• Additional federal restrictions apply to possession or receipt of firearms or ammunition by minors, prohibited persons, or other restricted categories as defined by federal law.

Colorado Transfer Requirements:
All in-person firearm transfers conducted by Backcountry Outpost within the State of Colorado are subject to Colorado law, which generally requires purchasers to be at least 21 years of age to purchase firearms, subject to limited statutory exceptions, as well as compliance with mandatory background checks, waiting periods, and all other applicable transfer regulations.

Customers are solely responsible for ensuring they meet all applicable legal eligibility requirements within their jurisdiction prior to placing an order or attempting to complete a transfer. Backcountry Outpost reserves the right to refuse, cancel, or delay any transaction that does not comply with applicable law.

Governing Law:
These Terms of Service and any disputes arising out of or relating to these Terms, our products, or our Services shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to conflict of law principles. You agree that any claim or cause of action arising out of or relating to these Terms or your use of our Services shall be brought exclusively in the state or federal courts located within the State of Colorado. You hereby consent to the exclusive jurisdiction and venue of such courts and waive any objection based on improper venue or inconvenient forum.

Compliance:
You agree to use our Services in accordance with all local, state, and federal laws. We reserve the right to refuse service, terminate accounts, or cancel orders at our sole discretion to maintain legal compliance.

2. Firearms Sales & Regulatory Compliance

FFL Requirements:
All firearms purchased through our website must be shipped to and transferred through a valid, licensed Federal Firearms Licensee (“FFL”) in accordance with all applicable federal, state, and local laws and regulations. The purchaser is solely responsible for selecting, verifying, and coordinating the transfer with their chosen FFL, including confirming that the selected FFL is willing and legally authorized to receive and transfer the firearm. Backcountry Outpost shall not be liable for transfer delays, refusal by the receiving FFL, additional transfer or storage fees, or any inability of the purchaser to lawfully complete the transfer.

Background Checks:
All in-person firearm transfers are contingent upon the successful completion of all required background checks conducted through the National Instant Criminal Background Check System (“NICS”) and/or applicable Colorado state background check systems. All transfers are further subject to any mandatory waiting periods and additional legal requirements imposed under federal, state, or local law. Backcountry Outpost reserves the right to deny or cancel any transfer that does not meet applicable legal requirements.

Failed Transfers:
Federal law prohibits the transfer of firearms to any individual who fails or receives a denial under a required background check or who is otherwise legally ineligible to possess a firearm. If a purchaser is unable to complete a lawful transfer, Backcountry Outpost reserves the right to cancel the order. Firearms subject to canceled transfers remain the property of Backcountry Outpost or its authorized distributor. Orders canceled due to failed or prohibited transfers may be subject to a restocking fee of twenty percent (20%) of the purchase price, plus all applicable shipping, transfer, administrative, and processing costs, except where otherwise restricted by applicable law.

Restricted Jurisdictions:
Backcountry Outpost complies with all applicable federal, state, and local laws and regulations governing firearm accessories, magazine capacity restrictions, and regulated firearm components. Customers are solely responsible for understanding and complying with all laws applicable to their jurisdiction prior to placing an order. If an order is placed for any item that is restricted, prohibited, or otherwise unlawful in the purchaser’s jurisdiction, Backcountry Outpost reserves the right, at its sole discretion and without prior notice, to cancel, refuse, or modify the order. Backcountry Outpost shall not be liable for orders placed in violation of applicable laws or regulations.

California Residents (AB 1263):
Pursuant to applicable California law and regulatory requirements, orders for certain firearm accessories, parts, or manufacturing components shipped to the State of California may require additional verification and compliance measures, which may include, but are not limited to:

• Submission of a valid government-issued photo identification matching the shipping address associated with the order.
• Execution of a signed acknowledgment confirming compliance with applicable California firearm manufacturing and ownership laws.
• Adult signature verification (21 years of age or older) required at the time of delivery.

Backcountry Outpost reserves the right, at its sole discretion and without prior notice, to refuse, cancel, restrict, delay, or modify any order shipped to or originating from the State of California if such order may violate, conflict with, or create compliance risk under applicable federal, state, or local laws, regulations, or enforcement guidance.

3. Inventory & Third-Party Integration

Live Inventory:
Our website features a "Live Inventory" feed powered by distribution partners, and may fluctuate.

Dropshipping:
Items may ship directly from a partner warehouse ("Dropship"). While we strive for real-time accuracy, distributor stock levels fluctuate. If an item becomes unavailable after your order is placed, we will issue a full refund immediately.

Third-Party Services:
Your use of third-party tools (payment processors, manufacturer links) is at your own risk. Backcountry Outpost is not liable for the privacy practices or technical inaccuracies of these third parties.

4. SMS & Digital Communication

Express Consent:
By opting in, you consent to receive automated communications from Backcountry Outpost only.

Data Privacy:
We comply with 10DLC regulations and do not sell or share mobile data.

Opt-Out:
Reply STOP at any time to unsubscribe.

Express Consent:
By opting into our SMS/Mobile alerts, you provide express "One-to-One" consent to receive automated marketing and order updates from Backcountry Outpost only.

Data Privacy:
We strictly adhere to 10DLC regulations. We do not sell, share, or rent your mobile data or consent to third parties, affiliates, or distributors. Your information is used exclusively for Backcountry Outpost communications.

Opt-Out:
You may reply STOP at any time to cancel SMS communications.

5. User Accounts & Content

Account Security:
You are responsible for maintaining the confidentiality of your account credentials.

User Content:
Any reviews or photos you submit remain yours, but you grant Backcountry Outpost a non-exclusive license to use and display this content to promote our Services.

Prohibited Conduct:
Harassment, abusive language, or any attempt to "scrape" or reproduce our digital content without permission will result in immediate account termination.

6. Payments, Shipping, & Returns

Pricing:
All prices are in U.S. Dollars. Prices and shipping estimates are subject to change without notice.

Taxes:
Applicable federal, state, and local taxes will be added at checkout based on your billing/shipping address.

Firearm Returns:
Once a firearm is transferred to you by an FFL, it is considered "Used" and cannot be returned.

Accessory Returns:
Unopened accessories may be returned within 14 days, subject to a [X]% restocking fee. Return shipping is the responsibility of the buyer.

7. Limitation of Liability & Warranty

"As Is" Basis:
Our Services and products are provided "as is." Backcountry Outpost is not liable for manufacturer-provided technical inaccuracies in syndicated feeds.

Warranties:
All products are sold with the manufacturer's warranty only.

Damages:
To the maximum extent permitted by law, Backcountry Outpost shall not be liable for any direct, indirect, or consequential damages resulting from the use, misuse, or illegal modification of products purchased from us.
